It is imperative that the Maine Legislature take seriously its duty to uphold and enforce the U.S. Constitution — a good way for it to begin is to restore constitutional money and nullify unconstitutional federal laws on this topic.
Article I, Section 10, of the U.S. Constitution plainly states that “No State shall…make any Thing but gold and silver Coin a Tender in Payment of Debts.” Unfortunately, both the federal government and the states have significantly departed from this important provision.
In fact, a federal law prevents the use of gold and silver as money unless “authorized by law”:
Whoever, except as authorized by law, makes or utters or passes, or attempts to utter or pass, any coins of gold or silver or other metal, or alloys of metals, intended for use as current money, whether in the resemblance of coins of the United States or of foreign countries, or of original design, shall be fined under this title or imprisoned not more than five years, or both.
It’s long overdue that Maine begins to enforce Article I, Section 10, once again.
Good first steps toward restoring constitutional money include:
- Officially recognizing gold and silver coins as legal tender;
- Eliminating all taxes on gold and silver, thus treating gold and silver as money; and
- Establishing a state bullion depository, which would encourage the use of gold and silver in everyday financial transactions.
Additionally, such measures are important steps toward nullifying the unconstitutional Federal Reserve, which has a monopoly on money, and also reducing Maine’s financial dependence on the federal government. They would also help Maine avoid the federal government’s planned “Central Bank Digital Currencies,” which severely threaten privacy and individual freedom.
Article VI of the U.S. Constitution obligates state officials to uphold the Constitution and nullify all laws not “made in Pursuance” of it. Officials at all levels of government must push back against the federal government’s many unconstitutional laws and agencies, and robustly enforce the Constitution and only those laws “made in Pursuance thereof.”
Urge your state representative and senator to support legislation that nullifies the Federal Reserve and other unconstitutional federal monetary policies, and that fully restores sound money in Maine.
