Members of the Nebraska Legislature are seeking to pass legislation to nullify unconstitutional federal gun control.
Legislative Bill 194 (LB 194), titled the Second Amendment Preservation Act, is sponsored by Senator Steve Halloran (R-Hastings).
If passed, LB 194 would prohibit any agency or government entity in Nebraska from “participat[ing] in any way in the enforcement of any federal firearms law” that “does not exist under the law of this state.”
LB 194 would also prohibit these agencies or entities from using any resources to enforce, or help enforce, those federal gun control actions, and it includes penalties for disregarding the bill’s provisions.
Although LB 194 would not end all gun control in Nebraska, “it would represent a massive shift in strategy going forward” by nullifying all such federal actions without a concurrent state law and encouraging the abolition of Nebraska’s remaining gun control laws.
Article VI of the U.S. Constitution makes clear that “[t]his Constitution, and the Laws of the United States which shall be made in Pursuance thereof … shall be the supreme Law of the Land.” Thus, laws that are not in pursuance of the Constitution cannot be enforced.
It is important that officials at all levels of government begin to push back against the lawless federal gun control regime and robustly enforce the Constitution and only those laws “made in Pursuance thereof.” By nullifying large portions of these unconstitutional federal actions, LB 194 is an excellent first step for Nebraska to properly enforce the Constitution on the issue of gun control.
