1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your use of the JBS Mobile App (the “App”) operated by The John Birch Society (“JBS,” “we,” “our,” or “us”).

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App

2. Description of Services

The App provides access to content, services, and products associated with:

  • The John Birch Society (educational content, publications, articles, archives, and organizational information)
  • Shop JBS (products, publications, and merchandise available for purchase)

Through the App, users may:

  • Access informational content and publications
  • View articles and media
  • Access member or archive content (where applicable)
  • Purchase products through the integrated store
  • Subscribe to newsletters or updates

3. Eligibility

You must be at least 13 years of age to use this App.

By using the App, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

4. User Accounts

Some features of the App may require you to create an account.

You agree to:

  • Provide accurate and complete information during registration

We reserve the right to suspend or terminate accounts that violate these Terms.

Products purchased through the App are processed through the Shop JBS online store.

By placing an order you agree that:

  • You are authorized to use the payment method
  • Prices and availability may change without notice

Payments are processed securely through third-party payment processors. JBS does not store full payment card details on its servers.

Orders may be refused or cancelled at our discretion, including in cases of suspected fraud or pricing errors.

6. Shipping and Returns

Shipping times, costs, and return policies are governed by the policies associated with the Shop JBS store.

Additional details regarding shipping and returns may be provided at checkout or within the store section of the App.

7. Intellectual Property

All content available through the App, including but not limited to:

  • Articles
  • Publications
  • Graphics
  • Logos
  • Videos
  • Text
  • Software

is the property of The John Birch Society or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

Users may not:

  • Copy
  • Reproduce
  • Distribute
  • Modify
  • Publicly display

any content without prior written permission.

8. Acceptable Use

You agree not to use the App to:

  • Violate any applicable law or regulation
  • Harass, threaten, abuse, or harm other users
  • Impersonate another person or organization
  • Upload or distribute malicious code, viruses, or harmful software
  • Attempt to gain unauthorized access to systems, accounts, or networks
  • Interfere with or disrupt the operation or security of the App
  • Scrape, extract, or harvest data from the App without authorization
  • Use the App for fraudulent or misleading activities

Violation of these rules may result in suspension or termination of access to the App.

9. Third-Party Services and Links

The App may contain links to third-party services, websites, or payment providers.

These services are not controlled by JBS, and we are not responsible for:

  • Their content
  • Privacy practices
  • Terms of service

Your interactions with third-party services are governed by their respective policies.

10. Disclaimer of Warranties

The App and all content, services, and materials available through the App are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, The John Birch Society disclaims all warranties, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of information
  • Continuous or uninterrupted availability of the App

We do not guarantee that the App will be free from errors, interruptions, security vulnerabilities, or harmful components.

Your use of the App is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by law, The John Birch Society shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:

  • Use of or inability to use the App
  • Purchases made through the App
  • Errors or interruptions in service
  • Unauthorized access to user data

Your use of the App is at your own risk.

12. Indemnification

You agree to indemnify and hold harmless The John Birch Society, its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your use of the App
  • Violation of these Terms
  • Violation of any rights of another party

13. Termination

We reserve the right to suspend or terminate access to the App at any time if:

  • These Terms are violated
  • There is suspected misuse of the platform
  • Maintenance or technical issues require service interruption


Users may also request deletion of their account and associated data at any time by contacting us at the email address provided in the Contact Information section. We will process such requests in accordance with applicable laws and our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time.

If changes are made:

  • The “Last Updated” date will be revised
  • Continued use of the App constitutes acceptance of the updated Terms

15. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App shall be resolved through binding arbitration rather than in court, except where prohibited by law.

Arbitration shall be conducted in the State of Wisconsin, United States, in accordance with the rules of the American Arbitration Association.

By agreeing to these Terms, you agree that:

  • Disputes will be resolved on an individual basis only
  • Class actions or collective proceedings are not permitted

Nothing in this section prevents either party from seeking relief in small claims court where permitted by law

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the United States and the State of Wisconsin, without regard to conflict of law principles.
