

Support HB 1052 and HCR 6004 to Stop Carbon-capture Pipelines in South Dakota

Please help enact legislation reining in eminent domain by contacting your state legislators. Urge them to stand up for property rights, end eminent domain for private utility projects, and support HB 1052, HCR 6004, and any similar legislation.
Why it Matters
URGENT: The Senate State Affairs Committee has scheduled a hearing for HB 1052 on Monday, March 3, at 10:00 a.m. Central Time. The hearing will take place in Room 414 of the South Dakota State Capitol.

Members of the South Dakota Legislature are seeking to enact legislation protecting individuals’ property rights while pushing back against eminent domain and carbon-capture pipelines.
House Bill 1052 (HB 1052) is sponsored by Representative Karla Lems (R-Canton) and Senator Mark Lapka (R-Leola) and cosponsored by 40 other representatives. If enacted, it would prohibit the use of eminent domain for carbon-capture pipelines.
Meanwhile, House Concurrent Resolution 6004 (HCR 6004), sponsored by Tina Mulally (R-Rapid City) and cosponsored by nine other legislators, condemns carbon-capture pipelines and federal efforts to promote them.
Senate Bill 49 (SB 49) would have banned eminent domain for various “green” utilities, including carbon-capture pipelines. Unfortunately, the Senate State Affairs Committee killed the bill by a 7-1 vote.
Despite currently having the ability to use eminent domain, carbon-capture pipelines are entirely private and will not directly benefit the public. Furthermore, some of the companies that would profit from them are foreign-based and have troubled histories.
Additionally, the carbon-capture pipelines are closely connected to the UN’s Agenda 2030 “sustainable development” scheme to eliminate private property and totally reshape society in the name of fighting “climate change.” The pipelines also are associated with serious safety concerns, and have been shown to be a poor investment.
Contact your state senator and urge him or her to strongly stand up for property rights — and against Agenda 2030 — by enacting HB 1052 and HCR 6004 and resisting efforts to water down the legislation.
