Restore Sound Money in Missouri with SB 735, HB 1955, HB 1867, and HB 2257

Members of the Missouri General Assembly are seeking to enact legislation helping restore sound money and enforce the U.S. Constitution’s monetary provisions.

Senate Bill No. 735 (SB 735) and House Bill No. 1955 (HB 1955), titled the Constitutional Money Act, are respectively sponsored by Senator William Eigel (R-Weldon Spring) and Representatives Doug Richey (R-Excelsior Springs) and Bill Hardwick (R-Waynesville). Meanwhile, House Bill No. 1867 (HB 1867) is sponsored by Representatives Richey and Hardwick. House Bill No. 2257 (HB 2257) is sponsored by Representative Michael Davis (R-Kansas City).

On January 17, 2024, the Senate Veterans, Military Affairs and Pensions Committee passed SB 735 out of committee.

If enacted, these bills would take the following actions:

  • Officially recognize gold and silver coins as legal tender;
  • Eliminate capital-gains taxes on gold and silver, thus treating gold and silver as money; and
  • Authorizing Missouri to invest at least 1 percent of all state funds in gold and silver.
  • Banning state and local government entities from seizing gold or silver.

These bills are a great first step toward enforcing the Constitution’s monetary provisions. Article I, Section 10, of the U.S. Constitution plainly states that “No State shall…make any Thing but gold and silver Coin a Tender in Payment of Debts.” It’s long overdue that states begin to enforce this provision once again.

Additionally, these bills are important steps toward nullifying the unconstitutional Federal Reserve, which has a monopoly on money, and also reducing Missouri’s financial dependence on the federal government. They will also help Missouri avoid the federal government’s planned “Central Bank Digital Currencies,” which severely threaten privacy and individual freedom.

Article VI of the U.S. Constitution obligates state officials to uphold the Constitution and nullify all laws not “made in Pursuance” of it. Officials at all levels of government must push back against the federal government’s many unconstitutional laws and agencies, and robustly enforce the Constitution and only those laws “made in Pursuance thereof.” SB 735, HB 1955, HB 1867, and HB 2257 are excellent models for other states to follow.

Urge your state representative and senator to support SB 735, HB 1955, HB 1867, and HB 2257, and to fully restore sound money in Missouri.
