Why it Matters

U.S. Representative Anna Paulina Luna (R-Fla.) has introduced legislation to repeal the USA PATRIOT Act. The “American Privacy Restoration Act” (H.R. 3245), would repeal the USA PATRIOT Act and uphold the Fourth Amendment-protected rights of every American. The bill states:

SECTION 2. REPEAL OF USA PATRIOT ACT.

The USA PATRIOT Act (Public Law 107-56; 115 Stat. 272) is repealed, and each provision of law amended by such Act is amended to read as such provision read on October 25, 2001.

Passed after the September 11, 2001, attacks, the USA PATRIOT Act granted federal agencies power to monitor phone calls, emails, and internet activity without a warrant. Congress claimed the Patriot Act would be a tool to combat terrorism, yet it has repeatedly been weaponized by rogue Deep State actors within U.S. intelligence agencies to spy on innocent Americans, interfere in elections, and target political enemies. As Representative Luna stated in her press release:

For over two decades, rogue actors within our U.S. intelligence agencies have used the Patriot Act to create the most sophisticated, unaccountable surveillance apparatus in the Western world. My legislation will strip the deep state of these tools and protect every American’s fourth amendment right against unreasonable searches and seizures. It’s past time to rein in our intelligence agencies and restore the right to privacy. Anyone trying to convince you otherwise is using ‘security’ as an excuse to erode your freedom.

H.R. 3245 would address the unconstitutionality of the PATRIOT Act’s surveillance provisions. The Fourth Amendment explicitly protects Americans from unreasonable searches and seizures. The PATRIOT Act, however, allows warrantless surveillance and the collection of personal data under vague national security claims.

H.R. 3245 confronts the Deep State’s surveillance state, which prioritizes power and control over adherence to the Constitution. By repealing the PATRIOT Act, H.R. 3245 would ensure that federal agencies can no longer violate the God-given rights of Americans, protected by the Constitution, under the guise of security. It would restore the pre-9/11 legal framework, reining in unchecked government overreach and safeguarding civil liberties.
