Why it Matters

Members of the Michigan Legislature are seeking to nullify the REAL ID Act by repealing the state’s compliance with this unconstitutional law.

House Bill No. 4473 (HB 4473) and House Bill No. 4474 (HB 4474) are sponsored by Representative James DeSana (R-Carleton) and four other representatives.

According to a press release, these bills would:

• Repeal Michigan’s compliance with the federal REAL ID Act
• Block state agencies from enforcing or expanding its provisions
• Reassert state control over licensing and identification systems

In other words, HB 4473 and HB 4474 would take a major step toward nullifying an unconstitutional and dangerous federal law that is paving the way for a national ID system.

Not only does the federal government have absolutely no authority to create a national ID system, but Real ID amounts to yet another step toward a federal surveillance state, enabling the creation of a national facial recognition database. Furthermore, the act’s requirement that one must have such a document in order to travel domestically is a dangerous violation of individual liberty.

Enacting HB 4473 and HB 4474 would defang this threat in Michigan, and it is essential that state legislators support these bills.
