

Support SB 1014 and HCR 2037 to Nullify Federal Gun Control in Arizona

Members of the Arizona State Legislature are seeking to pass SB 1014 and HCR 2037, which would likely be the strongest and most comprehensive nullification of unconstitutional federal gun control laws in the country.

Why it Matters
URGENT: HCR 2037 has passed the House by a 32-27 vote, and SB 1014 has passed the Senate by a 17-11 vote. Contact your state legislators, and urge them to support and enact SB 1014 and HCR 2037.
Members of the Arizona State Legislature are seeking to expand the state’s nullification of federal gun control.
Senate Bill 1014 (SB 1014) is sponsored by Senator Wendy Rogers (R-Tempe). If enacted, it would decriminalize firearm suppressors in Arizona.
This bill is important because it would effectively and automatically nullify federal suppressor regulations under Arizona’s 2021 2nd Amendment Firearm Freedom Act.
Meanwhile, House Concurrent Resolution 2037 (HCR 2037), titled the “Shall not Be Infringed Act,” is sponsored by Representative Alexander Kolodin (R-Scottsdale) and two other representatives. If enacted, it would propose a ballot measure to remove fully automatic firearms, short-barreled rifles and shotguns, and firearm sound suppressors from Arizona’s list of “prohibited weapons,” thus nullifying equivalent federal regulations. In February, this resolution passed out of committee.
SB 1014 and HCR 2037 are a good application of Article VI of the U.S. Constitution, which states “[t]his Constitution, and the Laws of the United States which shall be made in Pursuance thereof … shall be the supreme Law of the Land.”
Since firearm-suppressor regulations violate the Second Amendment — and the federal government has no authority under Article I, Section 8, to regulate firearms — they cannot be considered “made in Pursuance thereof” and, thus, are not “the supreme Law of the Land.” Unfortunately, in the last several decades, thousands of unconstitutional laws on the federal, state, and even local levels have been created and enforced.
Because of this, it is important that officials at all levels of government begin to push back against this lawless regime and robustly enforce the Constitution and only those laws “made in Pursuance thereof.” SB 1014 and HCR 2037 are a strong start to this, and it is an excellent model for other states to follow.
Urge your state representatives and senator to nullify federal gun control in Arizona with SB 1014 and HCR 2037, and to push back against all other unconstitutional laws at every level of government.
