Why it Matters

U.S. Representative Andy Biggs (R-Ariz.) has introduced legislation to abolish the Occupational Safety and Health Administration (OSHA). H.R. 86, the “Nullify Occupational Safety and Health Administration (NOSHA) Act,” seeks to eliminate the unconstitutional regulatory agency. The bill declares:

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Nullify Occupational Safety and Health Administration Act’’ or the ‘‘NOSHA Act’’.

SEC. 2. IN GENERAL.

The Occupational Safety and Health Act of 1970 is repealed. The Occupational Safety and Health Administration is abolished.

Article 1, Section 8 of the Constitution enumerates the powers of Congress, but it does not include the authority to regulate private businesses and manage workplace safety. Additionally, the Tenth Amendment confirms that powers not specifically granted to the federal government are reserved to the states and the people, affirming that Congress has no constitutional authority to regulate private businesses.

OSHA has imposed unconstitutional regulation on workplaces since its establishment under President Richard Nixon with the Occupational Safety and Health Act in 1970. Since its creation, OSHA has exerted unchecked power, granting inspectors the ability to enter workplaces, issue crippling fines, and enforce regulations without due process. H.R. 86 would return OSHA’s responsibilities back to the states, where they belong.

As Representative Biggs noted in a press release, OSHA’s existence is another instance of unconstitutional federal government overreach:

“OSHA’s existence is yet another example of the federal government creating agencies to address issues that are more appropriately handled by state governments and private employers…. Arizona, and every other state, has the constitutional right to establish and implement their own health and safety measures, and is more than capable of doing so. It’s time that we fight back against the bloated federal government and eliminate agencies that never should have been established in the first place. I will not let OSHA push Arizona around with their bureaucratic regulations and urge my colleagues to support my effort to eliminate this unconstitutional federal agency.”

Congress ignored its constitutional bounds by passing the Occupational Safety and Health Act. By abolishing OSHA, Representative Biggs’ bill would end this federal overreach and help restore constitutional adherence. Every state has the sovereign right to establish its own workplace-safety standards based on local needs. OSHA violates state sovereignty, and imposes one-size-fits-all rules that unconstitutionally overrule state laws.

Not only is OSHA illegal, but it is part of the Deep State’s plan to abolish individual freedom in the U.S. As Alan Stang wrote in American Opinion in 1975:

Some businessmen have told your reporter of their fear that if they speak up, O.S.H.A. may close them down. The answer to that is: You have said nothing so far, and you are already almost out on the street. If you continue to do and say nothing, you will wind up crushing rock for the government, where the ‘protection’ of O.S.H.A. will not apply. Before it is too late, you must realize that O.S.H.A. is not a labor-management disagreement. It is part of a Conspiracy by the Socialists who run our government to shut you down and take over. You have nothing to lose and everything to gain, if you stand and fight.

Accordingly, it is imperative that patriots stand up against this illegal and unaccountable agency. Not only should state legislatures constitutionally nullify OSHA, but Congress must enact H.R. 86 to abolish it outright.
