Why it Matters
A proposed amendment to the Constitution of Virginia has been introduced by Virginia Senator Jennifer Boysko (D-Fairfax). If successful, Virginia Senate Joint Resolution No. 247 (SJR 247) would amend the Virginia Constitution to establish a fundamental right to reproductive freedom, including abortion.
It is imperative that Virginia legislators oppose this resolution and uncompromisingly defend God-given rights, including the right to life for the preborn.
The constitutional amendment proposed by SJR 247 would establish a constitutionally protected right in Virginia to abortion, preventing government restrictions on abortion and related care except under limited conditions that still allow broad access to abortion.
SJR 247 passed its first reference in the 2025 General Assembly session, and must pass again to be submitted to voters for approval. If approved by voters, it will add a new section to Article I of the Constitution of Virginia. The proposed amendment reads, in part:
Section 11-A. Fundamental right to reproductive freedom.
That every individual has the fundamental right to reproductive freedom, including the ability to make and carry out decisions relating to one’s own prenatal care, childbirth, postpartum care, contraception, abortion care, miscarriage management, and fertility care.
An individual’s right to reproductive freedom shall not be, directly or indirectly, denied, burdened, or infringed upon unless justified by a compelling state interest achieved by the least restrictive means.
SJR 247 would enshrine the destruction of human life in the Virginia Constitution, undermining the unalienable, God-given rights of the preborn, and enable policies that prioritize abortion, contraception, and “fertility care” over the protection of life.
The right to life is the most fundamental, God-given, and unalienable right asserted in the Declaration of Independence and protected by the Fifth and 14th Amendments to the U.S. Constitution.
Abortion policy at all levels of government, local, state, and federal, represent an unprecedented violation of the God-given right to life. Government should never be allowed to enshrine or promote the destruction of innocent life, regardless of the rationale for imposing these tyrannical measures. Virginia ought to forbid the practice of abortion, along with other grotesque methods of population control, entirely and uphold the sanctity of life for every person, especially preborn children.
