Abby Lee (R):<\/strong> 1-208-332-1325, ALee@senate.idaho.gov<\/li>\n<\/ul>\n\n\n\n<p>Members of the Idaho Legislature are seeking to pass a resolution applying to Congress to \u201ccall a convention for proposing an amendment,\u201d under <a href=\"https:\/\/jbs.org\/constitution\/#Article_V\" target=\"_blank\" rel=\"noreferrer noopener\">Article V<\/a> of the Constitution, otherwise known as a federal <a href=\"https:\/\/jbs.org\/concon\/\" target=\"_blank\" rel=\"noreferrer noopener\">constitutional convention<\/a> (Con-Con), or a \u201c<a href=\"https:\/\/jbs.org\/video\/understanding-article-v\/17-constitutional-convention-or-convention-of-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">convention of states<\/a>,\u201d as some erroneously call it.<\/p>\n\n\n\n<p>Senate Concurrent Resolution No. 112 (<a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2024\/legislation\/SCR112.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">SCR 112<\/a>) follows the wording of Mark Meckler\u2019s Convention of States (COS) Project application, urging Congress to call a convention to propose amendments \u201cthat impose fiscal restraints on the federal government, limit the power and jurisdiction of the federal government, and limit the terms of office for its officials and for members of Congress.&#8221;<\/p>\n\n\n\n<p>Senate Concurrent Resolution No. 114 (<a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2024\/legislation\/SCR114.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">SCR 114<\/a>) applies to Congress for a convention to propose a congressional term-limits amendment. (However, term limits would do nothing to limit the federal government or improve our representation in Congress. For example, they would <a href=\"https:\/\/thenewamerican.com\/us\/politics\/congress\/term-limits-a-restraint-on-liberty-not-on-corruption\/\" target=\"_blank\" rel=\"noreferrer noopener\">throw out the best<\/a> congressmen along with the worst. Furthermore, term limits <a href=\"https:\/\/thenewamerican.com\/opinion\/term-limits-are-not-the-answer\/\" target=\"_blank\" rel=\"noreferrer noopener\">ignore the most serious problems<\/a> our nation faces, including fiscally-irresponsible policies and lack of adherence to the Constitution. Term limits in California have failed to limit the state&#8217;s government.)<\/p>\n\n\n\n<p>Senate Concurrent Resolution No. 115 (<a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2024\/legislation\/SCR115.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">SCR 115<\/a>) would apply to Congress for a convention to propose a so-called Balanced Budget Amendment (BBA). However, every BBA proposal, including SCR 115, actually <a href=\"https:\/\/thenewamerican.com\/us\/politics\/constitution\/the-unbalanced-budget-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">contains major loopholes<\/a> that would allow reckless spending to continue and even constitutionalize spending that currently is unconstitutional.<\/p>\n\n\n\n<p><em><strong>Any <a href=\"https:\/\/thenewamerican.com\/article-v-convention-will-it-work\/\" target=\"_blank\" rel=\"noreferrer noopener\">Article V convention<\/a>, no matter how well intentioned, is likely to devolve into a&nbsp;<a href=\"https:\/\/thenewamerican.com\/is-a-runaway-article-v-convention-a-myth-1787-proves-otherwise\/\" target=\"_blank\" rel=\"noreferrer noopener\">runaway convention<\/a>&nbsp;that would reverse many of the Constitution\u2019s limitations on government power and interference<\/strong><\/em>. In other words, <strong>a Con-Con&nbsp;<\/strong><a href=\"https:\/\/www.thenewamerican.com\/files\/TNA3521_ConReprint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>could accomplish the same goals<\/strong><\/a><strong>&nbsp;that many of its advocates claim to be fighting against. <\/strong>As evidence, both a <a href=\"https:\/\/thenewamerican.com\/convention-of-states-simulation-fails-to-dispel-runaway-threat\/\" target=\"_blank\" rel=\"noreferrer noopener\">2016<\/a> and <a href=\"https:\/\/thenewamerican.com\/opinion\/the-fix-is-in-at-the-simulated-con-con\/\" target=\"_blank\" rel=\"noreferrer noopener\">2023&nbsp;simulated &#8220;Convention of States&#8221;<\/a> resulted in amendments massively increasing the federal government and expanding its spending powers.<\/p>\n\n\n\n<p>The late Supreme Court Justice Antonin Scalia <a href=\"https:\/\/thenewamerican.com\/justice-scalia-s-warning-of-a-constitutional-convention\/\" target=\"_blank\" rel=\"noreferrer noopener\">understood<\/a> the danger of a constitutional convention. While he voiced support for one at a <a href=\"https:\/\/www.youtube.com\/watch?v=reFbh7mbMPc\" target=\"_blank\" rel=\"noreferrer noopener\">1979 event<\/a>, the justice had reversed his opinion by 2014 due to the uncertainty of what could come out of it. In 2015, Scalia reiterated his opposition to an Article V convention, stating <strong>\u201cthis is not a good century to write a constitution.\u201d<\/strong> Furthermore, <strong><em><mark class=\"has-inline-color has-vivid-red-color\">what kind of delegates would Idaho send to such a convention? Constitutionalist conservatives or RINO moderates and leftist Democrats?<\/mark><\/em><\/strong><\/p>\n\n\n\n<p>On December 9, 2021, constitutionalist U.S. Representative <a href=\"https:\/\/thenewamerican.com\/freedom-index\/legislator\/m001184\/\" target=\"_blank\" rel=\"noreferrer noopener\">Thomas Massie<\/a> (R-Ky.), warning against a Con-Con, <a href=\"https:\/\/twitter.com\/RepThomasMassie\/status\/1469129059229749250\" target=\"_blank\" rel=\"noreferrer noopener\">tweeted<\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Show me a single state where Constitutionalists comprise a majority of the state legislature.<\/p>\n\n\n\n<p>At this point in history, an Article V Convention of the States would be a disaster.<\/p>\n<\/blockquote>\n\n\n\n<p>In 1979, then-U.S. Senator Barry Goldwater of Arizona, correctly warned about an Article V convention:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>If we hold a constitutional convention, every group in the country \u2014 majority, minority, middle-of-the-road, left, right, up, down \u2014 is going to get its two bits in and we are going to wind up with a constitution that will be so far different from the one we have lived under for 200 years that I doubt that the Republic could continue.<\/p>\n<\/blockquote>\n\n\n\n<p>In addition to its unpredictable nature, <strong><em>an Article V convention also threatens U.S. national security.<\/em><\/strong> In 1984, when the U.S. was only two states away from Congress calling a federal constitutional convention under the guise of proposing a balanced budget amendment to the Constitution, former U.S. Secretary of Defense Melvin Laird <a href=\"https:\/\/jbs.org\/assets\/pdf\/Melvin-Laird-Con-Con-1984-Original.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote an op-ed<\/a> warning of the perils convening a convention. Secretary Laird correctly noted that such a convention\u2019s \u201cscope and authority aren\u2019t defined or limited by the Constitution.\u201d Of the implications of holding such a convention, Laird warned:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>If a convention were called, our allies and foes alike would soon realize the new pressures imposed upon our republic. The mere act of convening a constitutional convention would send tremors throughout all those economies that depend on the dollar. It would undermine our neighbors\u2019 confidence in our constitutional integrity and would weaken not only our economic stability but the stability of the free world. That\u2019s a price we cannot afford.<\/p>\n<\/blockquote>\n\n\n\n<p>Both Goldwater and Laird considered an Article V Convention threatening to the continuity of the United States\u2019 republican form of government. It would be foolhardy and downright reckless to disregard these and other legitimate concerns.<\/p>\n\n\n\n<p>An Article V convention possesses the inherent power to propose <strong><em>any<\/em><\/strong> changes to the U.S. Constitution, including drafting and proposing an entirely new \u201cmodern\u201d (i.e. socialist) constitution. Instead, <strong><em>the Idaho Legislature should consider <\/em><\/strong><a href=\"https:\/\/jbs.org\/constitution\/#Article_VI\" target=\"_blank\" rel=\"noreferrer noopener\"><strong><em>Article VI<\/em><\/strong><\/a><strong><em> and <\/em><\/strong><a href=\"https:\/\/jbs.org\/nullify\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong><em>nullify<\/em><\/strong><\/a><strong><em> unconstitutional laws.<\/em><\/strong><\/p>\n\n\n\n<p>Furthermore, <strong><em>state lawmakers should also consider rescinding any and all previously passed Article V convention applications to Congress, regardless of the desired amendment(s).<\/em><\/strong> Passing rescission resolutions will help prevent aggregating past Article V convention applications with those from other states to force Congress to call a convention.<\/p>\n\n\n\n<p>Above all, <strong><mark class=\"has-inline-color has-vivid-red-color\">urge your state representative and senator to oppose SCR 112, SCR 114, SCR 115, and all other pro-Article V convention resolutions, and to instead consider <\/mark><\/strong><a href=\"https:\/\/thenewamerican.com\/state-legislators-must-use-nullification-to-enforce-the-constitution\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>nullification<\/strong><\/a><strong><mark class=\"has-inline-color has-vivid-red-color\"> as a safe and constitutional means to limit government.<\/mark><\/strong><\/p>\n\n\n<div class=\"lazyblock-jbstna-video-ZjLWGq wp-block-lazyblock-jbstna-video\"><div class=\"container jbstna_playlist\">\r\n\t<div class=\"row\">\r\n\t\t\t<div class=\"col-12 col-md-12 col-lg-12 text-center px-2\">\r\n\t\t\t\t\t<div class=\"video-container\">\r\n\t\t\t<div class=\"video-embed container text-center ratio ratio-16x9\"><iframe class=\"rumble embed-responsive-item\" width=\"640\"
